DMCA Copyright Policy

2.3 Important Warnings

⚠️ False Claims: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

📋 Public Record: Your DMCA notice may be forwarded to the party that posted the allegedly infringing content. It may also be published or posted publicly (with personal information redacted).


3. Our Response to DMCA Notices

3.1 Investigation Process

Upon receipt of a valid and complete DMCA notice, we will:

  1. Acknowledge receipt (typically within 1-3 business days)
  2. Investigate the claim by reviewing the allegedly infringing material
  3. Evaluate whether the use falls under fair use or other exceptions
  4. Make a good faith effort to contact the user who posted the content (if applicable)

3.2 Takedown Actions

If we determine that a takedown is appropriate, we may:

  • Remove or disable access to the allegedly infringing material
  • Remove the entire file or document containing the material
  • Terminate access for repeat infringers
  • Take any other action we deem appropriate in our sole discretion

3.3 Response Timeline

Target Response Time: 5-10 business days from receipt of a complete and valid notice.

Please Note: This timeline is a goal, not a guarantee. We are not legally obligated to respond within any specific timeframe, and complex cases may require additional time.

3.4 No Obligation to Act

We reserve the right, in our sole discretion, to:

  • Remove content that we believe may infringe copyright, regardless of whether a formal DMCA notice has been filed
  • Decline to remove content that we believe does not infringe or falls under fair use
  • Seek additional information before taking action

4. Filing a DMCA Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification.

4.1 Requirements for a Valid Counter-Notification

Your written counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of:
    • The Federal District Court for the judicial district in which your address is located (if you are in the United States), OR
    • The appropriate court in Georgia (if you are outside the United States)
  6. A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

4.2 How to Submit Your Counter-Notification

Send your counter-notification to the same DMCA Agent contact information listed in Section 2.2 above.

4.3 What Happens Next

If we receive a valid counter-notification:

  1. We will forward it to the party who filed the original DMCA notice
  2. We will inform that party that we may restore the removed material in 10-14 business days
  3. We will restore the material unless the copyright owner files a court action seeking an injunction against the alleged infringer

5. Repeat Infringer Policy

5.1 Termination of Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users or account holders who are deemed to be repeat infringers.

5.2 Definition of Repeat Infringer

A "repeat infringer" is a user who has been the subject of:

  • Two (2) or more valid DMCA takedown notices, OR
  • One (1) valid DMCA notice followed by continued infringing activity

5.3 Our Discretion

We reserve the right to terminate access to our Website for any user we believe, in our sole discretion, is a repeat infringer, regardless of whether the user has been the subject of formal DMCA notices.


6. Limitations and Disclaimers

6.1 No Obligation to Monitor

We have NO obligation to:

  • Monitor content on the Website for copyright infringement
  • Proactively seek facts or circumstances indicating infringing activity
  • Verify the accuracy or validity of DMCA notices or counter-notifications

6.2 Good Faith Actions

All of our actions in response to DMCA notices are taken in good faith. We make no representations or warranties regarding:

  • Whether any material actually infringes copyright
  • Whether any use constitutes fair use
  • The accuracy of any claims made in DMCA notices

6.3 Safe Harbor Protection

We claim protection under the DMCA's safe harbor provisions (17 U.S.C. § 512). By promptly responding to valid DMCA notices and maintaining this policy, we limit our liability for copyright infringement claims related to user-generated content.

6.4 No Waiver of Rights

Nothing in this policy shall constitute:

  • A waiver of any rights or defenses available to us under applicable law
  • An admission that any content is infringing
  • An assumption of liability for third-party content
  • A guarantee that we will take any specific action in response to any notice

7. Misuse of the DMCA Process

7.1 Liability for False Claims

If you knowingly misrepresent that material is infringing, you may be liable under 17 U.S.C. § 512(f) for:

  • Damages incurred by us
  • Damages incurred by the alleged infringer
  • Costs and attorneys' fees

7.2 Abuse and Bad Faith

We reserve the right to:

  • Seek damages from any party that abuses the DMCA notice or counter-notice process
  • Report abuse to appropriate authorities
  • Refuse to process future notices from parties who have submitted false or abusive notices
